What is Probate?

Probate is the process of gathering all of a deceased person’s assets, and distributing these assets to beneficiaries in accordance with a Last Will and Testament, under Court supervision. Someone must be appointed by the Court as Personal Representative. To assist the Personal Representative, we generally notify the deceased person’s survivors that an estate has been opened, appear before the Probate Court on behalf of the Personal Representative, file all required documents with the Probate Court, prepare all required accountings for the Court and Beneficiaries, and finally assist in the distribution of assets in accordance with the Last Will and Testament. Many techniques exist to avoid the Probate process that can be achieved through Living Trusts or proper planning to accompany your Last Will and Testament.
